Last fall the FCC released a Declaratory Ruling and Third Report and Order (“Order”) that significantly limits state and local management of small wireless infrastructure deployment and associated fees for use of the rights of way and public property in the rights of way. The Order conflicts in a number of respects with the 2017 Colorado statute addressing small cell deployment in local rights of way.  This session covers what local governments are and should be doing to address the new state law and FCC Order, and will provide an update on the federal court litigation challenging the Order. This session includes planning, ROW code updates, Master License Agreement Developments, meetings with industry, process development, and more.
